Terms of service
OVERVIEW
Welcome to The Crow & Vellum.
The terms “we”, “us” and “our” refer to The Crow & Vellum.
The Crow & Vellum operates this website and online store, including its related information, content, features, products and services.
Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and services to you.
These Terms of Service, together with our Privacy Policy, Returns & Refunds Policy and any other policies referred to on our website, explain the terms on which you may access our website and purchase products from us.
By visiting, browsing, interacting with or purchasing through our website, you agree to these Terms.
Nothing in these Terms affects any statutory rights that you may have as a consumer.
1. ELIGIBILITY AND ACCOUNT INFORMATION
By using our website or placing an order, you confirm that you are legally capable of entering into a binding contract.
You agree to provide accurate, complete and current information when placing an order or creating an account.
You are responsible for maintaining the confidentiality and security of your account details and password.
You must not use our website or services for any unlawful or fraudulent purpose.
2. OUR PRODUCTS
The Crow & Vellum offers products which may include:
- fine-art prints and posters;
- framed wall art;
- made-to-order products;
- physical decorative goods;
- stationery and related products;
- digital artwork and downloadable products; and
- other products introduced to our collections from time to time.
Some physical products are fulfilled directly by The Crow & Vellum, while others may be produced and dispatched on our behalf by approved production and fulfilment partners, including Gelato.
We make reasonable efforts to display product descriptions, colours, dimensions, materials and images accurately.
However, colours and appearance may vary slightly depending on your screen, device settings, printing processes, natural materials and manufacturing variations.
For products using natural materials such as solid oak or ash frames, variations in grain, tone and appearance are normal and form part of the character of the material.
Product images shown in room settings or lifestyle environments may be illustrative and may not represent exact scale unless specifically stated.
3. ORDERS
When you submit an order, you are making an offer to purchase the products shown in your order.
An order is not considered accepted until we have accepted it and issued an order confirmation.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- incorrect pricing or product information has been displayed;
- payment cannot be authorised;
- we suspect fraudulent activity; or
- we are unable to fulfil the order.
If we cancel an order after payment has been taken, any amount paid for the cancelled item will be refunded.
Please review your order carefully before submitting it.
For made-to-order, personalised or digital products, production or supply may begin shortly after an order is accepted.
Your cancellation and return rights are explained in our Returns & Refunds Policy.
4. PRICES AND PAYMENT
Prices displayed on our website are shown in the currency indicated at checkout.
Prices may change from time to time, but changes will not affect orders that have already been accepted.
Any applicable taxes, delivery costs or other charges will be shown before you complete your order where required.
You agree to provide accurate and authorised payment information.
Payment must be successfully processed before an order can be fulfilled.
From time to time we may offer promotions, discount codes or special offers.
Promotional offers may be subject to additional terms and may be amended or withdrawn at our discretion, subject to applicable law.
5. SHIPPING AND DELIVERY
Estimated production and delivery times may be provided on product pages, during checkout or in your order confirmation.
Delivery estimates are not guaranteed unless expressly stated.
Some products may be produced and dispatched by third-party fulfilment partners, including Gelato.
Different products within the same order may therefore arrive separately.
We are not responsible for delays caused by circumstances genuinely outside our reasonable control, including carrier disruption, customs delays, severe weather, industrial action or other exceptional events.
However, your legal rights regarding delivery are not affected.
For consumer purchases, responsibility for the goods normally remains with us until they are delivered into your physical possession, or into the possession of a person identified by you to receive them.
If you nominate your own independent carrier or delivery arrangement which was not offered by us, different rules may apply.
Please ensure that the delivery address supplied at checkout is complete and accurate.
6. RETURNS, CANCELLATIONS AND REFUNDS
Returns, cancellations, damaged products, digital downloads and refunds are governed by our Returns & Refunds Policy.
That policy forms part of these Terms of Service.
Nothing in our Returns & Refunds Policy or these Terms limits your statutory consumer rights.
7. MADE-TO-ORDER AND PERSONALISED PRODUCTS
Some products may be manufactured or produced after your order is placed.
A product is not automatically considered personalised merely because it is printed or manufactured on demand.
However, products created according to your individual specifications or personalised specifically for you may be subject to different cancellation rights.
Details are provided in our Returns & Refunds Policy.
8. DIGITAL PRODUCTS
Some products sold by The Crow & Vellum may be supplied digitally rather than physically.
Digital products are licensed to you for personal use unless a product listing expressly states otherwise.
Purchasing a digital product does not transfer copyright or ownership of the artwork, design or underlying intellectual property to you.
You must not, unless expressly permitted:
- resell the digital file;
- redistribute or share the file;
- upload it to another marketplace;
- reproduce it for commercial resale;
- claim the design as your own;
- create competing digital products from it; or
- use it for commercial purposes.
Where digital content is supplied immediately, you may be required to expressly consent to immediate supply and acknowledge any effect this has on your statutory cancellation rights.
9. INTELLECTUAL PROPERTY
Unless otherwise stated, the content and intellectual property associated with The Crow & Vellum, including our:
- artwork;
- illustrations;
- photographs;
- product designs;
- branding;
- logos;
- written content;
- graphics;
- videos;
- product names;
- collection names; and
- website content
are owned by, licensed to, or used with permission by The Crow & Vellum.
They are protected by applicable copyright, trademark and intellectual-property laws.
You may access our website for your own personal and lawful use.
You must not reproduce, copy, distribute, modify, sell, commercially exploit or create derivative commercial works from our content without our prior written permission, except where permitted by law.
Purchase of a physical or digital product does not transfer copyright in the underlying artwork or design.
10. THIRD-PARTY SERVICES AND FULFILMENT PARTNERS
We may use third parties to help operate our business, including:
- Shopify;
- payment processors;
- delivery companies;
- printing and fulfilment providers;
- Gelato;
- analytics providers;
- advertising platforms; and
- digital-delivery services.
These providers may process information or perform services on our behalf where necessary to operate our store.
Use of your personal information is addressed in our Privacy Policy.
11. SHOPIFY
Our online store is powered by Shopify.
Shopify provides the ecommerce technology that enables us to operate our store, but purchases made through The Crow & Vellum are contracts between you and The Crow & Vellum.
Shopify is not the seller of our products.
Your use of certain Shopify services may also be subject to Shopify's own applicable terms and privacy policies.
12. PRIVACY
Personal information collected through our website is handled in accordance with our Privacy Policy.
Our website is hosted by Shopify, and some information may also be processed by Shopify and other service providers used to operate our store.
Please review our Privacy Policy for further information.
13. REVIEWS, FEEDBACK AND USER CONTENT
If you submit a review, photograph, comment, suggestion or other content to us, you confirm that you have the right to submit it.
You must not submit content that is unlawful, defamatory, abusive, misleading, discriminatory, infringing or otherwise inappropriate.
Where you voluntarily provide content such as a product review or customer photograph, you grant us permission to display and reproduce that content for the purpose for which it was submitted and, where appropriate, to promote our products and business.
We will not claim ownership of your underlying intellectual property merely because you submit feedback to us.
14. ERRORS AND INACCURACIES
We make reasonable efforts to ensure information on our website is accurate.
Occasionally, information may contain typographical errors, incorrect pricing, inaccurate descriptions or availability errors.
Where this occurs, we may correct the error and, where necessary, contact you regarding an affected order.
If an error materially affects your order, we will provide an appropriate remedy in accordance with applicable law.
15. ACCEPTABLE USE
You must not use our website:
- for unlawful or fraudulent purposes;
- to infringe our rights or the rights of others;
- to distribute viruses, malware or harmful code;
- to interfere with the operation or security of the website;
- to collect personal information unlawfully;
- to impersonate another person;
- to submit misleading information;
- to scrape or extract substantial portions of our website without permission where prohibited by law; or
- to attempt to circumvent security measures.
We may restrict or terminate access where we reasonably believe these Terms have been seriously breached.
16. AI AGENTS AND AUTOMATED SERVICES
We may allow compatible AI agents, shopping assistants, search services or automated systems to discover or interact with publicly available information about our products and services.
Any automated system accessing our services must comply with applicable technical restrictions, security controls and applicable law.
Automated systems must not attempt to circumvent access restrictions, security measures or authentication systems.
17. THIRD-PARTY LINKS
Our website may contain links to third-party websites or services.
We do not control third-party websites and are not responsible for their content, availability or policies.
You should review the terms and policies of any third-party site before purchasing from or providing information to that third party.
18. CONSUMER RIGHTS AND WARRANTIES
Nothing in these Terms excludes or restricts rights that cannot lawfully be excluded.
Products supplied by us must comply with applicable consumer-protection law.
Where you are purchasing as a consumer, you may have statutory rights where goods are:
- faulty;
- damaged;
- not as described;
- not of satisfactory quality; or
- otherwise fail to meet applicable legal requirements.
These statutory rights are separate from any additional commercial guarantee or voluntary return policy we may offer.
19. LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded.
If you are purchasing as a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was entered into.
We are not responsible for business losses suffered by consumers, including loss of profit, revenue, business opportunity or commercial interruption, where the product was purchased wholly for private use.
20. EVENTS OUTSIDE OUR CONTROL
We will not be responsible for failure or delay caused by circumstances outside our reasonable control.
Where such an event affects your order, we will take reasonable steps to minimise disruption and contact you where appropriate.
Your statutory rights remain unaffected.
21. SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed or limited to the minimum extent necessary.
The remaining provisions will continue to apply.
22. WAIVER
If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.
23. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, products, services or applicable law.
The current version will be published on this page.
Changes will not normally affect contracts already entered into unless required by law.
24. GOVERNING LAW
These Terms and any contract between you and The Crow & Vellum are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply where you live.
If you live in Scotland or Northern Ireland, you may also have the right to bring proceedings in your local courts where applicable.
Nothing in this section removes any rights you have under applicable consumer law.
